1.0 Agreement

1.1 Web site advertising (the "Service") on TMS web sites is a fee-based service offered by TMS Support, who own and operate a network of specialist sites. Advertising is provided to you ("You" or the "advertiser") pursuant to the terms and conditions of this agreement (the "Agreement").

1.2 This agreement covers advertisements placed on the TMS Support websites:

  • nvqweb.com
  • hscdiploma.org.uk
  • careworkmatters.org.uk
  • apprenticeshipweb.org.uk

1.3 By completing the advertising form, you represent and warrant that you are 18 years of age or older; that you have and agree to provide true, accurate, complete and current information (including an accurate and valid email address) as prompted by the advertising form; and that you agree to be bound by the terms and conditions of this Service Agreement, in the case of a Company, you are authorised to legally bind the Company to this Service Agreement

2.0 Editorial control

2.1 TMS Support reserves the right to determine the final design, layout and functionality of their web sites.

2.2 TMS Support reserves the right to edit copy or amend the text, layouts or photographs supplied, should it be considered necessary.

2.3 TMS Support reserves the right to refuse any advertisement for its web sites, and will not be liable for any loss or expense in so doing.

2.4 TMS Support reserves the right, in its sole and absolute discretion to determine the categorisation and positioning of each advertisement within the web site. Normally home page advertising will be displayed permanently on the home page and forum home page of the site. Resource page advertising will be displayed on the resource page above free listings and occasionally shown on the home page and forum home page. Positioning in relation to other adverts will be by random rotation.

2.5 TMS Support cannot be held responsible for any loss or damage resulting from any changes made to the photographs and copy submitted by the advertiser.

2.6 TMS Support, in its sole discretion, before considering any other criteria in determining whether to accept or decline a site for inclusion, stipulates that the site submitted by the advertiser must meet the following minimum criteria: The site must be in the English language (or have an English version available); The site must relevant to the web site users; it must comply with expected web standards; the site must be up and running 24 hours a day, 7 days a week; the site must not contain any parts under construction; all links on the site must work, link to relevant content and the pages must load quickly; the site must not be a mirror site or redirect to another Web site; the site must not, as determined by TMS Support's editorial team, contain or link to any content, products and services or other information that may be deemed illegal, pornographic, gratuitous, graphic violence, racist, offensive or infringes on or violates another party's rights.

3.0 Errors and omissions 

  • 3.1 TMS Support cannot accept any legal responsibility for the accuracy of the advertisements, or any alleged breaches of contract on an advertiser's part and the advertiser indemnifies TMS Support against all costs, expenses and losses arising out of a claim relating to the content of an advertisement.

  • 3.1 TMS Support will make every effort to safeguard all materials supplied, and return them if required, but cannot be held responsible for any loss or damage, however caused, and for any loss or damage sustained.

  • 2.2 Every effort will be made to reproduce faithfully all advertisements submitted, but TMS Support cannot be held responsible for any loss or damage or otherwise resulting from errors or omission.

  • 3.3 TMS Support does not warrant that the operation of the publishing site will be uninterrupted or error-free

4.0 Liability

4.1 In no event shall TMS Support be liable to the advertiser for any special, consequential, incidental or indirect damages, including lost profits.

4.0 Copyright

5.1 TMS Support shall be entitled to reproduce part or whole of any photographic material, images or text supplied by the advertiser for the purposes of advertising.

5.2 It is the advertiser's responsibility to obtain reproduction permission for all photographic and other material used in their advertisements. The advertiser warrants that he is the owner of the copyright in such material or is authorised by the owner thereof to grant to TMS Support the rights therein contained.

5.3 TMS Support cannot be held responsible for any infringement of copyright laws resulting from material supplied by the advertisers and the advertiser indemnifies TMS Support against any action brought for breach of copyright or other rights from the use of such material supplied by the advertiser.

6.0 Termination of advertising

6.1 Advertisers may choose to unsubscribe at any time by contacting TMS, direct with PayPal or by stopping their subscription payment. The advertisement will then be removed at the end of the period covered by the last payment.

6.2 If an advertiser attempts to enter unsuitable material into the our online databases, or persistently misuses the online systems, TMS Support reserves the right to remove the advertisement from our web site. No refunds will be paid.

7.0 Payment and Delivery

7.1 All payments for advertising are conducted using the PayPal website, which is an external company with its own terms and conditions.

7.2 Alternative methods of payment can be considered, please contact TMS Support.

7.2 Advertisements placed will be activated within 24 hours or less of payments being successfully processed.

7.3 Within the first 10 days of the advertisement being displayed, If for any reason the advertiser is not satisfied they are entitled to a full refund. In this event please email TMS Support.

8.0 Legal jurisdiction

8.1 These terms and conditions are governed by English law and advertisers accept the exclusive jurisdiction of the English courts to rule on any disputes.
